Terms and Conditions.
These Terms and Conditions of service for the use of Evolutiontel SIP Server (THE 'AGREEMENT') constitute a legally binding contract between Evolutiontel and the entity that agrees to and accepts these Terms and Conditons. Signing up for this service is deemed aceptance of these Terms and Conditions.
1. Access to Evolutiontels network is provided on an 'AS IS' and 'AS AVAILABLE' basis, and Evolutiontel makes no representations or warranties of any kind, whether express or implied, with respect to users access of our service, including but not limited to warranties of merchantability, non-fringement, title or fitness for a particular purpose. Further Evolutiontel makes no representations or warranties that the SIP server, or users access thereto, will be available at any given time, or will be free from errors, defects, omisions, in-acuracies, or failures or delays in delivery of data. non-exclusive basis. The user acknowledges and understands that our Service is in a devolopmental stage and that Evolutiontel makes no guarantees regarding availability or functionality thereof. User assumes, and Evolutiontel disclaim, total risk, responsibility, and liability for users access to and use of our service.
2. Evolutiontel reserves the right to revoke access to any user that is deemed to be engaged in any illegal activity, including but not limited to prank, malicious, or sales calls.
3. The Evolutiontel VOIP system does not provide access to emergency service numbers such as 000 or 911. We recommend you retain a regular telephony service for this purpose
4. User agrees to indemnify, defend and hold Evolutiontel, it's affiliates, directors, officers employees, agents, and licensors harmless from and against any and all claims, actions, expenses, losses and liabilities (Including courts costs and reasonable attorney's fess), arising from or relating to this agreement including users's access to and use of the Evolutiontel serviceto the maximum extent permitted by the applicable law, in no event shall Evolutiontel or any of its licensors, be liable for any indirect, special punitive, exemplary, or consequential damages, arising out of the access to or use of or inability to access or use our service, or that result from mistakes, omissions, interuptions, deletions of files, errors, defects, delays in transmission or operation or any failure of performance, even if advised of the possibility of such damages.
